What data is collected

This website uses no advertising trackers and does not build an advertising profile of you. Cloudflare Web Analytics counts page views without cookies and without identifying individual visitors. HubSpot provides the chat assistant and visit analytics; those set cookies, and they are set only if you accept them on the consent banner that appears on your first visit. Decline, and the HubSpot cookies are not set. You can change your choice at any time, and a Global Privacy Control signal from your browser is treated as a refusal. If you open the "Speak to us" assistant, that is a separate service and is described under AI-handled enquiries, calls and recordings below. Nothing else is collected automatically when you browse this site.

If you submit an enquiry using the contact form, the form builds a mailto link on your device and opens your email client. No data is sent to any server by the form itself — the information you provide (name, firm, email, phone, case details) is transmitted only through your own email client to rogernewbyconsulting@gmail.com.

If you book a call via the Calendly link, Calendly collects the information you provide. Calendly's own privacy policy applies to that service.

How data is used

Personal data received via email enquiries is used solely for the purpose of responding to your enquiry, assessing whether an instruction can be accepted, and — if instructed — providing expert witness or mediation services. Data is not used for marketing or shared with third parties except as set out below.

Lawful basis

Processing is based on legitimate interests (responding to professional enquiries and providing services under instruction) and, where an instruction is accepted, performance of a contract.

AI-handled enquiries, calls and recordings

When you telephone this practice, or use the "Speak to us" assistant on this website, you are speaking to an automated AI assistant, not to a person. The assistant says so at the start of every conversation. It takes your details and can arrange a scoping call with Roger Newby. It cannot give any technical view on your matter, and it does not decide anything about it.

What the assistant collects. Your name, firm and position; your direct dial and email address; whether the matter is civil, criminal, police conduct or regulatory; how it is funded, including whether Legal Aid Agency prior authority has been sought or granted; the names of the parties, the instructing firm, counsel, the other side's solicitors, and any insurer, manufacturer, dealer, repairer, haulier or contractor involved; the engineering question you are asking us to address; the approximate volume of papers; and any binding dates. We also keep the audio recording, a written transcript, and a structured summary produced from the conversation.

Recording. Calls and web conversations are recorded for training and monitoring purposes. The audio is kept for 30 days and then deleted. The transcript and the summary are kept for as long as we hold the enquiry record.

Why. To respond to your enquiry and take the steps you have asked us to take before any instruction is accepted (UK GDPR Article 6(1)(b)); and, for the recording and for our conflict checks, because we have a legitimate interest in the accuracy of our intake and in identifying conflicts of interest before accepting an instruction (Article 6(1)(f)).

Names of other people. To run the conflict check that our professional obligations require, the assistant asks for the names of everyone involved. That means we hold limited information about people who have not contacted us — their name and their role, and nothing more. We obtained it from the person who contacted us, and we use it only to check whether Roger Newby has any prior involvement, including through his separate practice as a civil and commercial mediator. This paragraph is the information we are required to give those individuals under UK GDPR Article 14. If you are named in an enquiry and wish to know more, please contact us.

Criminal and regulatory matters. Where an enquiry concerns criminal proceedings or police conduct proceedings, the names we hold may amount to personal data relating to criminal offences or alleged offences. We hold that information only so far as it is necessary for the conflict check and for deciding whether the instruction can be accepted, we hold no more of it than that requires, and we do not use it for any other purpose. It is never used to train any AI system.

No automated decisions. The assistant does not make any decision that produces legal effects for you or similarly significantly affects you. Every decision about whether to accept an instruction is taken by Roger Newby personally.

Who processes it. The conversation is carried and processed by Telnyx, our communications provider, which also supplies the AI assistant and the underlying language model. Data for these services is processed in Germany. Appointment booking uses Calendly. These providers act as our processors under written terms. Enquiry material is never used to train any third party's AI models.

Data retention

Enquiry correspondence is retained for six years from the date of the last communication (or, if an instruction is accepted, six years from the conclusion of the matter including any appeal period), in line with professional obligations and limitation periods. Data is then securely deleted. Audio recordings of enquiry calls are an exception and are deleted after 30 days; the transcript and structured summary are kept for the period above.

Your rights

Under UK GDPR you have the right to access, rectify, erase, restrict processing of, and port your personal data, and to object to processing. To exercise any of these rights, contact rogernewbyconsulting@gmail.com. You also have the right to lodge a complaint with the ICO (ico.org.uk).

Security

Reasonable technical and organisational measures are in place to protect personal data against unauthorised access, loss, or destruction.
