Nothing on this website constitutes legal advice, engineering advice, or a formal expert opinion. The interactive models, worked examples, and validation analyses on this site are demonstrations of method built on published, open data — they are not casework and should not be relied upon as such. Formal opinion requires inspection of the evidence under instruction.

No client relationship

Browsing this website or submitting an enquiry does not create a client relationship, an expert witness engagement, or any duty of care. A professional relationship arises only when a formal instruction is accepted in writing under agreed terms of engagement.

Automated intake assistant, and recording

The “Speak to us now” button on this site, and the telephone number published on it, connect you to an automated AI assistant, not to a person. The assistant says so at the start of every conversation. It takes your details and can arrange a call with Roger Newby. It cannot give any technical view on your matter, it cannot quote a fee, and it does not decide anything about whether an instruction is accepted — that decision is always taken by Roger Newby personally.

Conversations are recorded. Calls and web conversations are recorded for training and monitoring purposes, and to make sure the details taken down are accurate. The audio is kept for 30 days and then deleted; the written transcript and the summary produced from it are kept for as long as the enquiry record is held. Full details of what is collected, why, the lawful bases relied on, who processes it and your rights are set out in the privacy notice. If you would prefer not to be recorded, please email instead of using the assistant.

Names of other people. The assistant asks for the names of the parties, the firms and the other side’s representatives so that a conflict-of-interest check can be carried out before any instruction is accepted. Those names are used for that purpose and for scoping the work, and for nothing else. Where the assistant indicates that matters can proceed to the next stage, that means no conflict has been identified at that point; the full conflict check is completed by Roger Newby personally before any instruction is accepted.

Sending papers. You are welcome to send case papers at the outset, and it is usually quicker if you do. Use the secure route at send-papers.html rather than sending them to the assistant or by ordinary email, so that they land in storage correctly logged.

What happens to papers sent before the conflict check has cleared. They are held in secure storage and are not opened. The conflict check runs in parallel. If a conflict is identified, the papers are deleted without having been read and you are notified in writing that they have been. If no conflict is identified, Roger Newby reads them and responds with scope, fee and written terms of engagement. Sending papers does not create an instruction, and no work is carried out and no fee is incurred until written terms are agreed.
